This marks Rutherford's second child with 34-year-old German businessman Daniel Giersch, who was not present for the occasion. She married Giersch in August 2006 following her first marriage to Carlos Tarajano (from June 30, 2001 to January 11, 2002). The Gossip Girl star gave birth to their first child, a boy named Hermés Gustaf Daniel Giersch on October 18, 2006.
Unfortunately, Rutherford and Giersch's marriage did not last. She filed for divorce from Giersch on December 30, 2008, citing irreconcilable differences on the paperwork, which was submitted to a judge at Los Angeles Superior Court. At the time, Kelly was four months pregnant with her second child.
Rutherford and Giersch's split eventually became the subject of the media, especially after they started making some pretty nasty claims about one another. While Giersch fought to have sole custody of their son Hermes (claiming that he should live in Los Angeles with him because he will be neglected in NY while Rutherford is off shooting Gossip Girl), Rutherford claimed that there was an "investigation by the German government," and that Giersch could potentially be arrested in Germany. Additionally, Rutherford also stated that their son is in danger because Giersch leaves the swimming pool uncovered at his Los Angeles home.
"Hermes is very young, very active, not water safe and in a moment's notice, could fall into the swimming pool," Rutherford stated in a court filing.
Daniel, on the other hand, insisted that, "Hermes is not in any danger whatsoever with regard to my pool because I have the pool fully covered with an automatic pool cover. Hermés has no access to the pool area unless I take him to the pool myself."
